Terms & Conditions
1. The Nursery -
1.1 “The Nursery” is The Little Mowgli Nursery Poplars and references to “We”, “Our” or “Us” shall be construed accordingly.
1.2 “The Parents” are the parent(s) or guardian(s) or the person responsible for any child attending the Nursery as captured in the Child Registration Form and references to “You” or “Your” shall be construed accordingly.
1.3 “Fees” means any of:
(i) those fees detailed in the Child Registration Form;
(ii) any fees set out in any policies, procedures or marketing materials of the Nursery as updated from time to time; or
(iii) any other fees as agreed between You and the Nursery from time to time
2.Parent/Carer Agreement –
2.1 The Parent/Carer Agreement must be signed and returned to the Nursery before Your child’s first day of attendance. Signature(s) of the Parent/Carer Agreement confirms the understanding and acceptance of these terms and conditions.
3.Payment of Fees –
3.1 A registration fee will be charged upon booking a place at the Nursery, which is non-refundable and payable upon signing of this Parent / Carer Agreement. This registration fee reserves the agreed session plan and start date as confirmed by the Nursery Manager.
3.2 Unless expressly provided otherwise, the Parents shall be jointly and severally liable for their obligations under this Parent / Carer Agreement.
3.3 All Fees are payable in advance by Direct Debit, Bank Transfer or Debit/Credit Card via Stripe on the first calendar week of each month. Invoices will be issued by the Nursery to You monthly by email to the relevant email addresses captured in the Child Registration Form (or such other addresses as You notify to the Nursery from time to time) around a week before the beginning.
3.4 A secure link to submit Direct Debit details electronically will be sent by the Nursery Manager to the Billpayer’s email address.
3.5 We also accept the following methods of payment in relation to the payment of our Fees:
3.5.1 all forms of child care voucher, In relation to this clause 3.5, the Nursery reserves the right to request payment be made via Direct Debit.
3.6 Our Fees are annualised and split into equal monthly payments. Additional sessions above the fixed booking pattern (set out in the Child Registration Form and as updated and agreed between the Nursery and You from time to time) may be added to monthly invoices. You therefore agree that invoice values may vary.
3.7 One months’ written notice must be given to Us for any changes to Your fixed booking pattern and any changes in our Fees as a result of such change shall not become effective until one month from the date that the written notice was received by the Nursery.
3.8 If You do not make payment to Us by the due date for the relevant Fees, We reserve the right to charge interest to You on the overdue amount at the rate of 4%. This interest shall accrue on a daily basis from the due date until the date of actual payment of the overdue amount.
3.9 The Nursery reserves the right to suspend and/or terminate a Nursery place where the fee or balance of fee remains unpaid after the 20th of each calendar month or such other time period as may be stipulated in the invoice from the Nursery to You.
3.10 You agree that our Fees are payable during periods of absence from the Nursery, including holidays and sickness. No deductions or refunds will be made for sickness or holidays even where such periods are notified to Us in advance.
3.11 Our Fees are payable when the Nursery is closed for bank holidays and accordingly You agree that there will be no deductions or refunds in our Fees where the Nursery is closed for bank holidays.
3.12 Fees shall be payable by You, unless otherwise agreed by the Nursery, when the Nursery is closed due to events, circumstances, or causes by the reasonable control of the Nursery (which shall include, but not be limited to, acts of God (flood or other natural disaster), epidemic or pandemic, collapse of buildings, explosion or fire, any labour or trade dispute, strikes, industrial action and interruption or failure of a utility service). In any of these circumstances as envisaged by this clause, the Nursery will take reasonable actions to carry on the provision of childcare where possible.
3.13 Notwithstanding clause 3.6, the Nursery in its sole discretion may request that any extra sessions which are booked by You must be paid in advance.
3.14 All Fees are subject to annual review by the Nursery. In addition, the Nursery reserves the right to revise its Fees at any time upon providing You with reasonable notice. The Nursery endeavours to provide You with at least 4 weeks written notice in relation to any fee increase.
3.15 Any discounts to Fees agreed between You and the Nursery are subject to these terms and conditions and any other promotional terms and conditions relating to the relevant discount. All discounts operate at the Nursery’s sole discretion and may be subject to change or termination, with immediate effect.
4.Notice of Removal –
4.1 One month’s written notice must be provided to withdraw Your child from Nursery. You are liable for Fees during this notice period.
4.2 Registration Fees will not be refunded.
4.3 If You terminate Your place or for any reason cease use of the Nursery services or if Your Nursery place is terminated, You are required to pay any outstanding Fees.
4.4 We reserve the right to pass your details on to any third party debt collection agencies if we are unable to recover outstanding balances or arrears on Your Nursery accounts.
4.5 The Nursery reserves the right to exclude any children on a register where reasonable. This may be done with immediate effect without notice.
4.6 The Nursery reserves the right to exclude any parent where their behaviour is unreasonable and/or aggressive. This may be done with immediate effect without notice. The Nursery reserves the right to serve notice to withdraw a child’s place where Fees remain unpaid.
5.Child Protection –
5.1 Parents are required to abide by all Nursery security and safeguarding policies and procedures while on Nursery premises.
5.2 We do not condone contracting Nursery staff for extra services such as babysitting or other care services. The Nursery is neither responsible nor liable for any arrangement made to care for Nursery children out of hours or off our registered premises.
5.3 Management have the right to contact Social Services or The Child Protection Unit if a child discloses abuse, or if staff suspect abuse. This is in accordance with our Child Protection Policy.
6. Car park –
6.1 Parents are encouraged to use drop off zones where provided.
6.2 Drivers are asked to drive at a very slow speed and be cautious before setting off.
6.3 Any vehicle parked in the Nursery car park is parked at Your own risk.
7.Change of Address, Telephone Number or Circumstances –
7.1 Parents are required to inform the Nursery of any change of address, telephone number or circumstances.
7.2 Parents must provide the Nursery with two additional emergency contact numbers.
8.Illness –
8.1 Parents are asked to inform the Nursery if their child has been in contact with any infectious disease before the child is due to attend Nursery.
8.2 Children will not be allowed to attend Nursery if the illness is infectious or if the child is deemed by Nursery staff to be too unwell to attend.
8.3 Medicines cannot be stored overnight within the Nursery, the first dose of medication prescribed or non-prescribed must be administered by the parent in case of any allergic reaction, both prescribed and a limited range of nonprescribed medicines can be administered by a qualified member of staff, bottles will be checked to ensure the child’s name and the correct date is on the pharmacy label.
8.4 If Your child has suffered sickness or diarrhoea or shows signs of continued loose nappies, We withhold the right to request Your child remain absent from the Nursery for a period of 48 hours from the last loose nappy.
8.5 Children who become unwell during Nursery time must be collected as soon as possible after parents have been informed.
8.6 If Your child is too unwell to attend Nursery, parents are encouraged to contact the Nursery as soon as possible.
9.Non Attendance –
9.1 The Nursery reserves the right to withdraw any child’s place, without further notice, if that child fails to attend the Nursery without appropriate notice being given in terms 3 or 4 of these terms and conditions.
10.Collection –
10.1 No child will be allowed to leave the Nursery unaccompanied. The Nursery staff must know the person collecting the child. There will be no exception to this rule. Children will not be released into the care of anyone other than those named on the childcare registration form unless authorised by the parents personally, by telephone or in writing. On collection, the authorised person must bring a form of identification, as well as the child’s collection password. If We are not reasonably satisfied that an individual is allowed to collect Your child, We will not release the child into their care. In addition, a personal visit of introduction by the parents of anyone who will be collecting the child on occasions is encouraged so We are able to confirm their identity. You are required to inform us immediately if You are unable to collect Your child from the Nursery by the official collection time.
10.2 All children must be collected on time at the end of their session.
10.3 The Nursery reserves the right to charge You for unconfirmed late collection.
10.4 The Nursery may withdraw placement where children are consistently collected late.
11.Loss and Damage –
11.1 The Nursery cannot take responsibility for the loss or damage to property or clothing.
11.2 We discourage children from bringing toys into Nursery as We cannot be sure they are safe for all children to use and cannot be responsible for what happens to them. We do however, encourage comforters that will help children settle and these should be passed onto Nursery staff.
12.Change of Clothing –
12.1 Children must be appropriately dressed for all weather conditions. 12.2 Children must bring changes of clothing in a suitable bag, marked with their name.
13.Holiday -
13.1 Absence due to holidays remains chargeable in line with the booking pattern as at the time of absence.
13.2 We kindly request, where reasonably practicable, one month’s notice is provided for holidays and/or public holiday absence, where the Nursery is open during public holidays.
13.3 Where Your child attends the Nursery part time or on a funded place, sessions may not be swapped to accommodate holidays.
14.Data Protection -
14.1 Under data protection legislation, We are required to provide You with certain information about who we are, how We process Your personal data (and Your Child’s personal data), for what purposes and Your rights in relation to such personal data and how to exercise them. This information is provided in Our Privacy Policy and it is important that You read that information.
